DUI / DWAI / DWI
Denver, Colorado DUI / DWAI / DWI Attorneys
The consequences of a DUI / DWAI / DWI arrest can be serious when both short and long-term consequences are taken into account. If convicted, you face jail, the possible revocation of your license, fines, and you may be required to install an ignition interlock device. Further, your insurance rates will increase and your conviction will go on your permanent criminal record. Additionally, in Colorado you have only seven days to schedule a hearing to apply for a temporary license. If you fail to do so, your driver's license will be automatically suspended. At Gerash Steiner & Toray, P.C., our attorneys have the knowledge and resources needed to help clients avoid some of the more serious consequences of a DUI.
If you've been arrested on charges of drunk driving, contact DUI / DWAI / DWI lawyers at Gerash Steiner & Toray, P.C. today to schedule a consultation to discuss your case and the options available to you.
Challenging Your DUI Arrest
Since DUI penalties can be severe, it makes sense to challenge the validity of your arrest if there is reason to suspect any of the following:
- You were pulled over without reasonable suspicion
- An officer improperly administered the field sobriety test
- The breathalyzer used was not calibrated properly
When challenging DUI arrests, our attorneys review dashboard camera video footage to see if the stop was constitutional. We also request the maintenance records on the breathalyzer used and note any malfunctions or false-positives registered by it in the past. Our attorneys also review how a field sobriety test was conducted, whether it was on level pavement, and if it was performed in compliance with the National Highway Traffic Safety Administration's "DWAI Detection and Standardized Field Sobriety Testing Student Manual." When necessary, we hire experts who explain how fatigue, age, inner ear problems, or coordination problems can affect a person's ability to perform on a field sobriety test.
Drugs and Driving While Ability Impaired
Different prescription and over-the-counter drugs can affect a person's ability to drive by increasing fatigue or causing mental confusion. However, because field sobriety tests are, in many ways, designed to ensure failure, it's easy for someone who is tired or sick to stumble or have problems balancing. Over-zealous officers take this as evidence of impairment and arrest someone who is sick or taking prescription drugs for DWAI. Unlike DUI where a specific level of blood-alcohol saturation is considered illegal, DWAI depends more on an officer's judgment. As a result, there is greater room for doubt in a DWAI arrest involving drugs or prescription medication.
